Parking - Taking Action

The Problem

The lack of parking at Sky Pointe has been on top of the compliant list since day one.  Each day our community manager receives phone calls similar to this:
  • "There's not enough parking for my car!"
  • "Where are my guest supposed to park?"
  • "What?  You expect me to park down at Albertsons?" 
  • "Why did my car get towed, but my neighbor's didn't?"
This is a small sample of what the Board and Management Company hears from homeowners and residents daily.  Rightly so, these are valid concerns and rest assured the Board is doing every thing in it's authority to alleviate some of these issues. 

Some Background

From the beginning, the Board's authority to do something about this issue has been held in check due to a small clause found in the CC&Rs.

(item 4.13 Motor Vehicles)"...No Automobile, motorcycle, motorbike or other motor vehicle shall be parked upon any part of the Condominium except (i) in garages appurtenant to a Unit Owner's Unit, (ii) in driveways, provided that no vehicle may be parked on a driveway that is less than eighteen (18) feet long measured from the inside edge of the sidewalk to the face of the garage door, and provided further that no portion of any vehicle parked on a driveway eighteen (18) feet or longer shall be parked on any portion of a sidewalk adjacent to the driveway; and (iii) in a parking space that may be allocated to a specific unit as a Limited Common Element (and shall be marked as such).  Except as set forth in the preceding sentence, all parking spaces within the Common Elements shall be reserved for visitors of Unit Owners and Residents..."

This last sentence in the above paragraph has effectively ensured that the Board cannot make any changes to the way parking spaces are authorized, allocated, or managed.  In essence, according to the documents homeowners signed upon purchasing their unit, nearly every vehicle parked in a public spot inside Sky Pointe (with exception to guests) should be removed from the premise.  This certainly is not an enforceable option for the Board as under this enforcement, there would be minimal vehicles left on premise following this action. 

What We Are Doing

Ever since homeowners have taken seat on the Board of Directors, fixing this issue has been top priority.  The Board and Community Management Team worked diligently at securing approval from the Las Vegas Fire Department to open additional parking spaces throughout the community.  The most significant new areas being the row of parallel spots running along the property's northern perimeter.  This has helped our situation tremendously.

Additionally, the Board has secured contracts with Quality Towing that have included a "walk & tag" program to help remove vehicles that are being stored on property along with those without legal license plates and tags. 

Currently, the Board is discussing other options which may or may not include a parking permit system, authorized parking spaces for individual units, designated oversize-vehicle parking areas, and more.  At the time, these are only ideas on the table.  All of these solutions have positive and negative points.  The Board is very aware of these concerns and will hold Town Hall meetings in the coming months to hear from all residents on this issue. 

However, before any positive changes can be made in regards to parking, the CC&R item listed above has to be amended.  This can only be done through a special election in which at least two-thirds (66.6% - 208 units) of homeowners must approve of these changes.  It's very clear that this will require everyone's support.  A non-response on this election is equivalent to a "vote against" this proposal - a "NO" vote. 

In an effort to answer any questions and convey the importance of this election, the Board and other volunteers, will be visiting with each homeowner.  Everyone that calls Sky Pointe home, has to deal with the parking issue in some way or another.  Without homeowner support in amending these articles, your current homeowner Board or those that follow will be unable to respond to these issues.
